These Terms of Service ("Terms") govern your access to and use of XenorAI ("we," "us," "our"), a product of DevXcript, including our website, dashboard, and chatbot widget (collectively, the "Service"). By using the Service, you agree to these Terms.
1. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. By using the Service, you represent that you meet these requirements.
2. The Service
XenorAI provides an AI-powered chatbot widget combined with lead capture and automated email follow-up tools, allowing businesses to engage website visitors, capture leads, and send follow-up campaigns.
3. Account Registration
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information when creating an account.
4. Connected Accounts
If you connect a Google account for email automation, you authorize XenorAI to send emails on your behalf through that account, as described in our Privacy Policy. You are responsible for ensuring your use of this feature complies with applicable anti-spam and email marketing laws (such as CAN-SPAM, GDPR, or equivalent regulations in your jurisdiction).
5. Acceptable Use
You agree not to use the Service to:
- Send unsolicited, deceptive, or unlawful communications
- Violate any applicable law or regulation
- Infringe on the intellectual property or privacy rights of others
- Interfere with or disrupt the Service or its infrastructure
- Attempt to gain unauthorized access to any part of the Service
We reserve the right to suspend or terminate accounts that violate these Terms.
6. Free Plan and Usage Limits
During the free/beta phase, the Service is provided with certain usage limits (such as message volume, email sends, and product listings), which may change as we introduce paid plans. We will provide reasonable notice of material changes to plan features or pricing.
7. Intellectual Property
The Service, including its software, design, and content (excluding content you provide), is owned by DevXcript and protected by applicable intellectual property laws. You retain ownership of the content and data you input into the Service.
8. Third-Party Services
The Service integrates with third-party providers (such as Google, for authentication and email sending, and AI model providers). Your use of those integrations is also subject to the respective third party's terms.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available," without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that AI-generated responses will always be accurate.
10. Limitation of Liability
To the maximum extent permitted by law, DevXcript shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.
11. Termination
You may stop using the Service at any time. We may suspend or terminate your access to the Service if you violate these Terms or for any other reason, with reasonable notice where practicable.
12. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws applicable in the jurisdiction where DevXcript operates, without regard to conflict of law principles.
